Property Rights



Eminent domain authority and private property rights are essential prerequisites for a thriving economy and for economic and social development. Reforms are required in order to ensure a balanced compromise that addresses the natural tensions that exist between these two competing interests.

 

Members of the Texas Conservative Coalition will work to limit the exercise of eminent domain strictly to the traditional and essential public purposes, including historically accepted common carriers. Members will also ensure that constitutionally guaranteed "adequate compensation" is given everytime property is taken by eminent domain. "Public use" and "adequate compensation" must be well-defined to protect private property rights. Reforms are also required to ensure that a condemning entity makes good faith negotiations to acquire property through avoluntary purchase beforeresorting to to costly eminent domain proceedings.
